DUI
The Situation:  Defendant driving on I-95 and weaving in and out of the lane and onto the shoulder lane.  Law enforcement was called by anonymous caller.  Trooper responds and stops client after making observations consistent with report. Deputy was called to conduct DUI investigation.  Deputy reported that the Defendant had red, watery eyes, very emotional and unsteady.  Defendant refused breath/urine test and roadside sobriety exercises.  The Deputy believed that Defendant’s behavior was the result of her driving while impaired by alcohol or controlled substance. Result:  DUI Dismissed without trial or hearing required.  The State agreed with our argument that there was a lack of evidence to support the charges AND there was reasonable alternative explanation for the driving pattern and Defendant’s behavior.

 

No Valid Driver’s License
The Situation:  Deputy observes a vehicle driving on I-595 changing lanes multiple times without using the turning signals.  Upon making contact with the driver, the Deputy learns that the driver does not have a valid driver’s license.  Result: Motion to suppress all evidence for unlawfully stopping the Defendant was GRANTED; case dismissed.

 

DUI
The Situation:  Late in the evening, the arresting Officer notices a vehicle speeding down a street and sees the front tire of the vehicle strike the median.  The officer stopped the vehicle and reported that upon making contact with Defendant, she smelled an odor of alcoholic beverage coming from his breath.  The officer also reports red, watery eyes and slurred speech. The Defendant admits having a few beers with dinner at a local bar and grill.  The Defendant performs sobriety exercises on video at the jail but refuses to submit to a breath test. Result: DUI reduced to reckless driving.  The State agreed with our argument and after reviewing the video drop the DUI charges.

 

No Valid Driver’s License
The Situation:  Deputy stops vehicle for infraction and upon making contact with Defendant requests Florida Driver’s License.  Defendant is not a citizen or resident of the United States, but does have a valid Driver’s License from his country.  Result: Case dismissed without trial or hearing required.

 

Burglary
The Situation: 911 is called by a woman who claims that an African-American male came into the office inquiring about a job and while away from the desk, making copies of his job application and resume, the Defendant took her wallet.  She reported that upon confronting him and picking up the phone to call police, he returned the wallet and ran out, leaving behind all his information in the application and resume. She later identified the defendant out of a photo line-up.  Defendant was arrested for burglary.  Result: We persuaded the State to reduce the charges to misdemeanor petit theft based on the facts.  At trial we exposed the victim’s lack of credibility and the detectives’ inadequate investigation.  The jury returned a Verdict for the Defendant of NOT Guilty.

 

Driving While License Suspended
The Situation:  Officer stops vehicle for infraction and upon making contact with Defendant requests Florida Driver’s License.  Officer learns that the Defendant’s Florida license has been revoked because his work visa has expired.  Result: State agreed to change the charge and dismiss the DWLS.

 

Battery
The Situation: Woman calls law enforcement alleging that her living boyfriend dragged her by the hair and hit her.  Police respond and question both.  Defendant explains to police that he had to defend himself because she bit his arm.  Police arrest Defendant and charge him with domestic battery.  Result: On the day of trial, the State dropped the charges.

 

Possession of Cannabis
The Situation: Defendant is approached by officer while at a gas station for having an expired tag.  Officer notices a smell of marijuana in the vehicle and asks if he can search the vehicle.  Defendant waives her constitutional rights and agrees to the search.  Officer finds a pipe with marijuana.  Defendant is charged with possession of marijuana and drug paraphernalia.  Result:  We persuaded the State to allow Defendant into a diversion program. The Defendant completed the program and all charges were dismissed.

Petit Theft (Shoplifting)

The Situation: Defendant walks out of retailer without paying for merchandise.  Defendant was arrested and charged with petit theft.  Result: We persuaded the State to allow Defendant into a diversion program. The Defendant completed the program and all charges were dismissed.
