POSSESSION OF DRUGS

The Situation: Defendant is approached by officer while at a gas station for having an expired tag.  Officer notices a smell of marijuana in the vehicle and asks if he can search the vehicle. Defendant waives her constitutional rights and agrees to the search. Officer finds a pipe with marijuana.  Defendant is charged with possession of marijuana and drug paraphernalia. 

Result: We persuaded the State to allow Defendant into a diversion program. The Defendant completed the program and all charges were dismissed.
